Musgo de Roble markets natural wellness and aromatherapy products (including third-party brands), as well as diffusers and related accessories.

2) Acceptance of terms and ability to use

By accessing and using the Site, the user (“User”) fully accepts these Terms and Conditions. If you do not agree, you must refrain from using it. Use of the Site implies that the User:
a) Has the legal capacity to enter into contracts;
b) Use the Site for lawful purposes;
c) Provides truthful, accurate and up-to-date information.

3) Site access and service availability

Musgo de Roble makes reasonable efforts to keep the Site available and functional; however, it may be interrupted due to maintenance, updates, technical issues, force majeure, or at the Owner's discretion. Every effort will be made to minimize disruption, but uninterrupted availability and error-free operation are not guaranteed.

Access may require a password in certain sections. The User is responsible for safeguarding their credentials and for all activity conducted under their account.

4) Account registration and credential security

The User can create an account to expedite purchases, manage addresses, wish lists, and orders. Upon registration, they must:

• Provide truthful and complete information.
• Keep them updated.
• Do not share credentials; report unauthorized use.

Musgo de Roble may suspend or cancel accounts that violate these Terms, involve fraud, or present security risks.

5) Purchase process, orders and formation of consent

The purchase steps are shown in the checkout flow. Before confirming, the User can review the order details (products, quantities, price, taxes, shipping, total).
Consent is formed when the User confirms the order and the system validates the payment and sends the confirmation by email. Orders are subject to stock availability and fraud prevention verification.

Musgo de Roble may reject or cancel orders due to: lack of stock, obvious pricing error, unauthorized transaction, suspicion of fraud, incomplete information, or inability to deliver. In such cases, any payment received will be refunded via the same payment method.

6) Prices, invoicing, promotions and obvious errors

Prices are expressed in Mexican pesos (MXN) and include applicable taxes unless otherwise indicated.

Shipping costs are shown at checkout; free shipping applies when the current published conditions are met.

Promotions are of limited duration, cannot be combined unless expressly indicated, and may be subject to coupons, stock, or specific categories.

In case of obvious error in price, description or conditions (manifest error), Musgo de Roble may cancel or correct the order; if it has already been charged, the User will be refunded.

Electronic invoices are issued at the request of the User with a valid Taxpayer Identification Number (RFC) and within the tax deadlines. Omissions or inaccuracies in tax information attributable to the User prevent reissuance outside of the legal deadlines.

7) Payment methods, validation and fraud prevention

Payment methods enabled on the Site are accepted (e.g., Visa/Mastercard/Amex cards, wallets, transfers, and authorized platforms). Bank charges (fees, interest) not included in the price are the User's responsibility according to their contract with the issuer.

All transactions may be subject to automated systems and/or manual fraud prevention review. Musgo de Roble may require additional verification or cancel risky transactions. Card data is processed by certified payment providers; Musgo de Roble does not store sensitive payment data.

8) Shipments, delivery, risk and transfer of ownership

Coverage: Republic of Mexico. We do not ship to P.O. boxes or outside of Mexico.
Deadlines: Preparation: 1–2 business days after payment confirmation; estimated delivery: 3–5 business days depending on destination and courier. The maximum legal delivery time will not exceed 30 calendar days from order confirmation (except in cases of force majeure).
Tracking: The tracking guide will be sent by email.
Reception: A signature and contact phone number may be required. Once the package is delivered by the courier, the risk is transferred to the User. If the package arrives with visible damage or missing items, do not accept it and report it immediately to Customer Service with photos and your order number.

Incomplete addresses or errors attributable to the User may cause delays or rehabilitations with additional costs.

9) Returns, exchanges, refunds and legal guarantees

Returns are accepted when the product:
a) arrived damaged/defective;
b) is incorrect;
c) has expired.
Deadline to report: 10 calendar days from receipt (obvious damage: report immediately and do not accept).
Conditions: Unused, in original packaging, and with proof of purchase. After verification, a replacement or refund will be processed via the original payment method. Returns are not accepted for change of mind or for opened/personal use/hygiene products that have already been used.

Manufacturer warranties apply according to the product specifications and regulations; Oak Moss will assist in warranty management when applicable.

10) Site content: accuracy, updating, and limitations

Musgo de Roble strives to publish accurate and up-to-date information; however, omissions or inaccuracies may exist (colors may vary depending on the screen, batches, or packaging changes). Any errors detected will be corrected, but we will not be liable for indirect damages. Users are responsible for verifying the uses and precautions for each product.

11) Intellectual and industrial property (trademarks, content and licenses)

The Site and its elements (texts, photographs, graphics, logos, trademarks, designs, software, videos, infographics and “look & feel”) are protected by the Federal Copyright Law and the Federal Law for the Protection of Industrial Property.
Reproduction, distribution, public communication, modification or creation of derivative works is prohibited without prior written permission from the owners.

If the Site makes downloadable material available (e.g., guides), a personal, non-exclusive, and non-transferable license is granted, solely for private use and for the duration of legal protection. Commercial use is prohibited without express authorization.

The trademarks displayed, both our own and those of third parties, belong to their respective owners; their use without consent is an infringement.

12) User-generated content (UGC), reviews and assignment of rights

By posting reviews, comments, photos, or any UGC on the Site or official networks, the User declares and warrants that:

• He is the author or holds the necessary rights;
• Its content is lawful, truthful, does not infringe the rights of third parties, nor is it defamatory, violent, obscene, discriminatory, or advertising;
• It does not include sensitive personal data of third parties.

The User grants Musgo de Roble, free of charge, a non-exclusive, worldwide, irrevocable license for the legal term to reproduce, fix, communicate, edit, translate, create derivative works, and distribute the UGC on internal and external media (website, email, social media, catalogs, points of sale), mentioning the alias if applicable. Musgo de Roble may moderate, not publish, edit, or remove UGC that violates these Terms.

13) User Code of Conduct

The User agrees not to:

• upload or disseminate illicit, offensive, defamatory, discriminatory, violent or obscene content;
• infringe the intellectual property or image rights of third parties;
• introducing viruses, bots, mass scraping or intrusion attempts;
• use the Site for proselytizing, spam or unfair competition purposes;
• impersonating others, manipulating prices, reviews, or promotions.

Musgo de Roble may suspend access and report illegal conduct to the authorities.

14) Third-party tools, links and sites

The Site may include links or integrations (payment gateways, social media, logistics services). These third parties have their own terms and policies. Oakmust does not control their content or practices and assumes no responsibility for them. It is recommended that you review their policies before using them.

15) Protection of personal data and cookies (references)

The processing of personal data is governed by the Oak Musg Privacy Policy and by the LFPDPPP.
The use of cookies is regulated in the Cookie Policy.
The User may exercise ARCO rights and revoke consent in accordance with applicable regulations.

16) Security, cyber-risks and technical measures

Musgo de Roble implements administrative, technical, and physical measures to protect information and ensure service continuity. However, absolute security does not exist on the Internet; the User acknowledges the inherent risks and uses the Site at their own risk.

17) Responsibilities and limitation of liability

To the fullest extent permitted by law, Musgo de Roble will not be liable for:

• failures of the Internet, telecommunications, hosting or third-party software;
• loss of data, loss of profits or indirect damages;
• misuse of the Site by the User or third parties;
• color/image differences due to displays;
• delays or non-compliance due to force majeure.

The total liability, if any, is limited to the amount actually paid by the User for the related product/service.

18) Force majeure and fortuitous event

There will be no liability for non-performance due to force majeure or acts of God (e.g., natural phenomena, widespread failures, pandemics, acts of authority, labor disputes, large-scale cyberattacks). Performance will be suspended during the event and will resume as soon as reasonably possible.

19) Modifications to the site and these terms

Musgo de Roble may modify the Site, its features, policies, and these Terms to comply with the law or improve the service. Current versions will be posted on the Site with the date of the update. Continued use of the Site constitutes acceptance of the changes.

20) Notifications, complaints and “takedown” procedure

To report infringements (example: intellectual property, personal data, unlawful UGC):

• detailed description of the infraction,
• Specific URL, evidence and
• statement under oath of ownership or representation.

Musgo de Roble will evaluate and, if necessary, remove or block the content and contact the parties.

For consumer complaints, the User may contact PROFECO in accordance with the Federal Consumer Protection Law.

21) Applicable legislation and jurisdiction

These Terms are governed by the laws of the United Mexican States (including the Commercial Code, LFPC, LFPDPPP, Federal Copyright Law and LFPPI).
Any dispute will be submitted to the competent courts of Santiago de Querétaro, Querétaro, the parties waiving any other jurisdiction by reason of present or future domicile.
